This Privacy Policy (this "Privacy Policy") describes how UC Technology, Inc. d/b/a Gizmogo ("Gizmogo" or "we" or "our") manages your personal information during your use of our Services (as defined in the User Agreement). By signing up, registering, accessing and/or using our Services, you expressly consent to the collection, storage, use and disclosure of such information as set forth in this Privacy Policy.

1. Information Collection.

When you use our Services, you provide two types of information: (i) personal information that can be used to identify you, and (ii) non-personal information that cannot be used to identify you.

2. Personal Information.

When you sign up and/or register to use our Services, Gizmogo may require that you provide certain personal information. Personal information is requested to verify and/or authenticate your identity, to help confirm the accuracy of data provided, and to prevent identity fraud and theft. Personal information requested which may include, but is not limited to, the following:

• Your contact information, such as full name, physical address, email address, phone number, and payment (e.g., credit card) and/or billing information;
• Make, model, condition and carrier, if any, of your device(s); and
• Transactional information based on your activities (e.g., buying or selling).

If you are over 13 years of age but under the 18 years of age, please obtain your parent or legal guardian’s permission to use or access our services. If you are under 13 years of age, do not use or access our services at any time or in any manner.

Protecting the privacy of persons less than 18 years of age is of utmost importance to Gizmogo. For that reason, Gizmogo does not knowingly collect or maintain personally identifiable information from persons less than 18 years of age. If Gizmogo learns that personally identifiable information of persons under 18 years of age has been collected through the use of our Services, then Gizmogo shall take appropriate steps to delete this information. If you are a parent or legal guardian of a person less than 18 years of age who has become a Member (as defined in the User Agreement), then please contact Gizmogo to have the account terminated and information deleted.

3. Non-Personal Information.

Gizmogo receives and collects non-personal information from server logs from your browser, including your IP address, the URL which you came from or go to, browser type, browser language, date and time of your query, cookie and similar technology information, and the pages you request while using our Services. This information may be used for internal record keeping, external statistics about our users as a whole, aggregating data about the traffic on our website, quality control, and to improve and/or optimize overall user experience. This website gathers IP addresses from all visitors and may use this information in a variety of ways, including, but not limited to, research and development purposes.

4. Cookies.

Gizmogo may use cookies and similar technologies (e.g., web beacons, pixels, ad tags and device identifiers) to recognize you and/or your device(s) on, off and across different Services and devices. By enabling cookies, Gizmogo can analyze your website data in an effort to improve your experience. • Authorized service providers and partners as it relates to our Services (e.g., payment processing, bill collection, customer support, merchant services, fraud prevention, marketing services);
• Third party identity verification services to assist in confirming information, if applicable; and/or
• Affiliated business entities should Gizmogo merge with or be acquired by said affiliated business entities.

You further acknowledge that the information you provide will be used for, among other things, to verify and/or authenticate your identity, to prevent identity fraud and theft; and to help with a smooth overall experience.

6. Data Storage and Protection.

Gizmogo respects your privacy and uses various measures to continuously protect your personal information from unauthorized access, alteration, and disclosure, including the use of:

• Storage of data and information in a secured location behind a firewall that is only accessible through a private network that is encrypted; and
• Review of our information collection, storage and processing practices to prevent unauthorized access to our systems.

Gizmogo takes appropriate technical measures against protecting your personal information. However, no security measures are perfect or impenetrable, and Gizmogo cannot guarantee that the information submitted to, maintained on, or transmitted will be completely secure. You agree that these features are provided as a convenience only and that Gizmogo has no responsibility or liability whatsoever for the deletion, loss, disclosure of, or failure to store or protect any information and/or other communications maintained, received or transmitted by the use of the Services.

7. California Residents.

If you are a California resident, you have the right to request information from Gizmogo regarding the manner in which Gizmogo may share your information with third parties for marketing purposes pursuant to California Civil Code Section 1798.83. Furthermore, you may request that Gizmogo delete your personal information, to direct Gizmogo not to share your information, to correct inaccurate information, and to limit the use and disclosure of your personal information. 8. Deletion Request Rights

You have the right to request that Gizmogo delete any of your personal information that Gizmogo collected from you and retained, subject to certain exceptions. If you would like to request deletion of any of your personal information that Gizmogo collects, please submit your written request to Gizmogo using the contact information provided below. Once Gizmogo receives and confirms your verifiable consumer request, Gizmogo will delete your personal information from our records, unless an exception applies.

Gizmogo may deny your deletion request if retaining the information is necessary for us to: 

• Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
• Direct security incidents, protect against malicious, deceptive, fraudulent or illegal activity, or prosecute those responsible for such activities.
• Debug products to identify and repair errors that impair existing intended functionality.
• Exercise free speech, ensure the right of anther consumer to exercise their free speech rights, or exercise another right provided for by law.
• Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. Seq.).
• Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship to us.
• Comply with a legal obligation.
• Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

10. Acceptance of and Changes to this Privacy Policy.

By using our Services, you hereby agree to this Privacy Policy in its entirety. Gizmogo reserves the right, in its sole discretion, to modify portions of this Privacy Policy at any time. If we do, we will let you know by appropriate means such as by posting the “Last Updated”date. All modifications will take effect immediately upon their posting on this website. Your continued use of our Services after any such modification constitutes your acceptance to such changes. We encourage you to periodically review this page and the other pages for the latest information. If you object to any changes, you must cease using our Services and terminate your account. By signing up, registering, accessing and/or using our Services, you expressly consent to the collection, storage, use and disclosure of such information as set forth in this SMS Privacy Policy. This SMS Privacy Policy is incorporated into the Terms & Conditions. By using the SMS Service, you agree to the terms of this SMS Privacy Policy. Gizmogo reserves the right, in its sole discretion to modify of change this SMS Privacy Policy at any time with or without prior notice to you. The date of the last update will be posted at the top of this SMS Privacy Policy for your convenience. This SMS Privacy Policy and any changes, are effective as soon as posted. Gizmogo uses Personal Information to (a) provide you with the SMS Service, (b) process and respond to inquiries, (c) improve the SMS Service, website and advertising and marketing efforts, (d) to send abandoned cart reminders if you added items to your shopping cart but did not complete check out, (e) if necessary, contact you with important announcements or messages, (f) research and development purposes, and (g) for aggregating anonymous information.

Each message that you send through the SMS Service is stored and retained on our servers, which may be owned by third parties.

5. Security.

Gizmogo takes precautions to ensure the security of your Personal Information, including ensuring that our third party service providers protect the security of your Personal Information. However, Gizmogo cannot guarantee that hackers or unauthorized persons will not gain access to your Personal Information despite our efforts. You should note that in using the SMS Service, your information will travel through third party infrastructures which are not under our control (such as third party SMS delivery platforms or your carrier’s network).

Gizmogo cannot protect, nor does this SMS Privacy Policy apply to, any information that you transmit to others. You should never transmit personal or identifying information to others.

6a. Opt-In.

You may opt-in by providing your mobile phone number, sending a mobile originating messaging containing an advertising keyword, or upon signing up with Gizmogo. In the event you opt-in, you agree to receiving recurring mobile message from us at the mobile phone number associated with your opt-in, even if such number is registered on any state or federal “Do Not Call” list. You agree that any mobile phone number you provide to us is a valid mobile phone number which you are the owner or authorized user. If you change your mobile phone number or are no longer the owner or authorized user of the mobile phone number, you agree to promptly notify us using the information below.

Your participation in the SMS Service does not require that you make any purchase from us and your participation in the SMS Service is voluntary.

6b. Opt-Out.

You may opt-out of the SMS Service at any time. If you wish out opt-out of the SMS Service and stop receiving mobile messages from us for any reason, reply STOP to the mobile number the message is sent from. You may continue to receive text messages for a short period thereafter while we process your request and you may receive a one-time opt-out confirmation message. You understand and agree that the foregoing is the only reasonable method of opting out. If you wish to rejoin the SMS Service again, you can sign up again.

Our SMS platform may not recognize requests that modify the foregoing commands, and you agree that we and our third party providers will not be liable for failing to honor such requests that do not comply with these requirements. We may also change the telephone number or short code we use to operate the SMS Service and we will notify you of any such change. You acknowledge that any requests sent to a telephone number or short code that has been changed may not be received by us and we will not be responsible for failing to honor a request sent to a telephone number or short code that has been changed.

7. Disclaimer.

This SMS Service is offered on as “AS-IS”basis and may not be available in all areas, at all times, or on all mobile providers. You agree that neither Gizmogo nor our third party providers will be liable for any failed, delayed, or misdirected delivery of any mobile messages or information sent through the SMS Service.
