As artificial intelligence (AI) technologies morph the digital realm, yet again, the tech titans are at a juncture between innovation and privacy. Meta, formerly Facebook, announced a week ago that it would suspend its plans of training machine-learning models using data from Facebook and Instagram users in the European Union (EU) and European Economic Area (EEA) on account of data privacy considerations.
The news came shortly after Meta decided to suspend training smart AI systems in Europe, following intense discussions with the Irish DPC or Data Protection Commission after EU data regulators pushed back against its arguments for what it dubbed ‘legitimate interests’ in processing the user-generated content it hosts (such as posts and images) in order to make its AI tools smarter. Meta’s reasoning, it can now be argued, was inconsistent with the EU’s General Data Protection Regulation (GDPR).
The DPC welcomed Meta’s move, but also stressed the need for ongoing dialogue to ensure that Meta complied with EU standards. Meanwhile, the privacy advocacy group Noyb filed formal complaints and issued warnings about Meta’s use of techniques known as ‘dark patterns’ to discourage opt-outs from AI data processing. Like other intervention by Noyb and supervisory authorities, this response reflects growing worries about the ethics of AI development.
Until its more recent moratorium, Meta had been planning to roll out a variety of AI-powered features in the EU with promises of personalised experiences ahead. There has also been a debate over what legal basis (under the GDPR) should be relied on when using user data for AI development without user consent. For example, a submission from Norwegian and other EU data protection authorities to the EC argued that user consent would be a more GDPR-friendly legal basis for processing.
By setting the deadline for opting out, and allowing EU users to back out of the decision for a data transfer within 30 days, Meta is effectively asking for consent after the fact, rather than in advance – which some critics worry could allow this collection of staggering quantities of data to become an entrenched business function without a clear egress for users whose information they’d rather not have included in AI training sets. The fracas over it demonstrates that solving the tension between technological progress and maximising individuals’ rights to privacy and access and control over their data is going to be an ongoing, murky and contentious one.
Meta’s pause on AI training in the EU illustrates these larger trends quite nicely. If the tech industry is serious about developing AI models, privacy protections and ethical concerns will become even more paramount. Whatever the outcome of Meta’s discussions with EU regulators and the privacy advocacy community, those precedents will continue to have implications for AI development and deployment around the world, especially in terms of user privacy, consent mechanisms and transparency.
Meanwhile, Meta has put its AI training efforts on hold. The situation, however, appears to be fluid. With the modifications to the privacy policy as well as Noyb’s legal actions, Meta’s approach to AI development in Europe seems likely to change. The extent of this change will be monitored by different stakeholders including users, regulators and privacy advocates, all hoping that we don’t lose touch with the human touch.

We will see where Meta’s next AI will move in Europe, if and when the time comes. For now, the fact that Max and others have raised the issue, and forced Meta’s hand on its AI, demonstrates the crucial role that activism and private voices can play in defending and raising the stakes of privacy.
Finally, Meta’s pause on AI training in the EU is, at least for now, the future of the outcomes of the negotiations between technological innovation and data privacy imperatives. As the digital zeitgeist develops, so too will the future of AI development and digital ethics worldwide.
